The Secretary of Agriculture can set aside up to 640 acres of National Forest land as a townsite when the land is next to an established community in Alaska or the eleven contiguous Western States and giving the land away better serves indigenous community goals than keeping it federal. After public notice and if a county, city, or other local government shows it needs the land, the Secretary can offer the area for sale to that government for at least its fair market value. The sale can require the local government to pass and enforce rules so use of the land won’t harm nearby National Forest lands.
