After a use-of-allocation review, the Secretary (or the Chief of the Forest Service when applicable) must change how many visitor-use days a recreation service provider gets for the rest of the permit. If the provider’s performance was satisfactory, each remaining year they get 125% of the visitor-use days they used in the review year, but not more than the number originally on their permit. If performance was less than satisfactory, each remaining year they get no more than 100% of the visitor-use days they used in the review year. The Secretary may temporarily assign unused visitor-use days made available under section 8542(c)(1)(B) to other existing or potential providers or to certain permit holders, including the public. If there are unallocated visitor-use days, the Secretary may at any time amend a permit to give extra days to a qualified provider.
