Anyone who imports or makes and sells digital audio recording devices or media must include the required notice and must submit the reports and royalty payments called for in section 1004. If a maker or importer starts selling a device in a new product category or using a new technology and has not filed a notice before, they must file a notice with the Register of Copyrights in the form the Register requires. Manufacturers and importers must also send quarterly and annual statements about their distributions to the Register, have an officer certify those statements, and include the royalty payments in section 1004. The Register will make rules for checking and auditing these reports, keeping information confidential, and sharing them in confidence with interested copyright parties.
