It makes it a crime to have a sexual act in certain federal places — like U.S. waters and property, federal prisons, or any facility holding people for the federal government — when the other person is between 12 and 15 years old and the actor is at least four years older. It also makes it a crime for someone to have sex with a person who is officially detained and under that person’s control or authority in those federal places. If a federal law enforcement officer has sex with someone who is under arrest, supervision, detention, or federal custody, they can be fined, go to prison for up to 15 years, or both. In cases about ages 12–15, the defendant can try to prove it was more likely than not they reasonably believed the other person was 16 or older. The government does not have to prove the defendant knew the other person’s exact age or the age gap.
