Title 18 › Part PART I— - CRIMES › Chapter CHAPTER 110— - SEXUAL EXPLOITATION AND OTHER ABUSE OF CHILDREN › § 2256
Defines key words used in this chapter about sexual images and children. "Minor" means anyone under 18 years old. "Sexually explicit conduct" covers real or staged sex acts (including oral, anal, or genital contact), sex with animals, masturbation, cruel sexual abuse, or lewd showing of the anus, genitals, or pubic area; a "graphic" version means you can see the genitals or pubic area. "Producing" means making, directing, printing, publishing, or advertising images. "Organization" means any non‑individual group. "Visual depiction" includes photos, movies, videotape, undeveloped film, and digital data that can be turned into images. "Computer" has the meaning given in federal law section 1030. "Custody or control" includes temporary supervision or responsibility for a child, even if the child was obtained illegally. "Child pornography" is any visual image of sexually explicit conduct when a minor was used to make it, when the image is a digital or computer image that looks like a minor, or when the image was changed to make an identifiable minor appear to be involved. "Identifiable minor" is someone who was a minor when the image was made or whose minor image was used and who can be recognized by face or a unique mark; you do not have to prove the person’s real name. "Indistinguishable" means an ordinary person would think the image is of an actual minor; this does not apply to drawings, cartoons, sculptures, or paintings.
