Special agents of the Bureau of Alcohol, Tobacco, Firearms, and Explosives, and any investigator or officer the Attorney General assigns to enforce federal criminal, seizure, or forfeiture laws, may carry guns, serve warrants and subpoenas, and make arrests without a warrant if a crime happens in their presence or if they have reasonable grounds to believe someone has committed or is committing a felony. ATF special agents may seize property that can be forfeited to the United States while doing their work. Customs rules about seizure, forfeiture, handling, reducing, or settling claims over property apply to these cases unless they conflict with section 983 of title 18, United States Code. The Attorney General can name who carries out customs duties for these forfeitures. Firearms forfeited under U.S. law are handled under section 5872(b) of the Internal Revenue Code of 1986.
