§3562 Imposition of a sentence of probation

Title 18 › Part PART II— - CRIMINAL PROCEDURE › Chapter CHAPTER 227— - SENTENCES › Subchapter SUBCHAPTER B— - PROBATION › § 3562

Last updated Apr 6, 2026|Official source

Summary

When a judge decides to put someone on probation, the judge must look at the factors listed in section 3553(a) that apply. The judge must use those factors to decide whether to give probation, how long it will last, and what rules the person must follow. Even though probation can later be changed or ended under section 3564 or 3565, corrected under Rule 35 or section 3742, or appealed and changed under section 3742 if it is outside the guideline range, a judge may still impose probation.
