It is illegal for anyone to purposefully crush an animal when the act affects trade between states or countries or happens in U.S. federal jurisdiction. It is also illegal to knowingly make, sell, market, advertise, exchange, or distribute an obscene photo or video that shows that kind of animal cruelty across state or national lines. The rule also applies to people outside the United States who intend their videos to be brought into the U.S. or whose videos are actually brought into the U.S. Violators can be fined, jailed for up to 7 years, or both. Some actions are not covered. Normal veterinary or farming care, slaughter for food, hunting/trapping/fishing and other lawful sporting or pest control, medical or scientific research, protecting a person’s life or property, and humane euthanasia are allowed. Sharing a video in good faith with police or sending it to someone only to check whether police should be notified is allowed. Accidental harm to an animal is not covered. Enforcement must follow section 3 of the Religious Freedom Restoration Act (42 U.S.C. 2000bb–1) and this federal rule does not replace state or local animal-protection laws. Definitions (one line each) animal crushing — purposely causing severe harm or death to a living non-human mammal, bird, reptile, or amphibian (for example, crushing, burning, drowning, suffocating, or impaling). animal crush video — any photo, film, video, or digital image that shows animal crushing and is obscene. euthanizing an animal — humanely causing rapid, painless loss of consciousness and death (for example, by proper anesthesia).
