Anyone who knowingly builds or pays for an underground tunnel that crosses the U.S. border with another country, unless it is a lawful tunnel known to the Secretary of Homeland Security and open to inspection by Immigration and Customs Enforcement, can be fined under federal law and jailed for up to 20 years. If a person owns or controls land and knows about or ignores such a tunnel on their property, they can be fined and jailed for up to 10 years. Using such a tunnel to illegally smuggle an alien, goods (in violation of section 545), drugs, weapons of mass destruction (including biological weapons), or a member of a terrorist organization (as defined in section 2339B(g)(6)) doubles the maximum prison time for the underlying crime. Attempts or conspiracies to commit these offenses get the same penalties as the completed crimes.
