Noncitizens may not vote in any election for federal offices — President, Vice President, members of Congress, the D.C. Delegate, or Resident Commissioner — unless the election also includes a separate state or local question that state or local law allows noncitizens to vote on and that part is run separately so they still cannot vote for the federal candidates. Someone who breaks this can be fined, jailed up to one year, or both. The ban does not apply if each parent (or each adoptive parent) was a U.S. citizen, the person lived in the U.S. before age 16, and they reasonably believed when voting that they were a U.S. citizen.
