§1755 Responsibilities of fair operator

Summary

The fair operator chosen by the Secretary of Commerce is treated as the only importer and the person responsible for receiving all items entered for that fair. The operator must repay the United States for actual customs costs to handle those items — for example, handling, inspecting, valuing, storing, destroying, or releasing them — including customs staff pay. The money must be returned to the same government account that paid it, as section 1524 says.

(a)Each fair operator designated by the Secretary of Commerce pursuant to section 1751 of this title shall be deemed the sole consignee and importer of all articles entered under section 1752 of this title for the fair for which such operator has been designated.
(b)The actual and necessary customs charges for labor, services, and other expenses in connection with the entry, examination, appraisement, custody, abandonment, destruction, or release of articles entered under section 1752 of this title, together with the necessary charges for salaries of customs officers and employees in connection with the accounting for, custody of, and supervision over, such articles, shall be reimbursed to the United States by the operator of the fair for which they are entered. Receipts from such reimbursements shall be deposited as refunds to the appropriation from which paid, in the manner provided for in section 1524 of this title.
