The President can sell import licenses at public auction and set the terms he thinks appropriate. Rules must, as much as possible while keeping the process fair and efficient, try to stop a few large importers from taking an unfair share of the imports. Here, "import license" means the papers used to run a quota that was put in place or changed after July 26, 1979 under: certain sections (125, 203, 301, 406) of the Trade Act of 1974; the International Emergency Economic Powers Act; authority in the notes to the Harmonized Tariff Schedule (but not quotas under section 22 of the Agricultural Adjustment Act of 1934); the Trading With the Enemy Act; section 204 of the Agricultural Act of 1956 (except meat or meat products); or any law made to carry out an international agreement (including commodity agreements but not agreements about cheese or dairy).
