When a World Trade Organization panel or the Appellate Body finds that a U.S. trade action broke rules under the Antidumping, Safeguards, or Subsidies Agreements, the U.S. Trade Representative starts steps to fix it. The Trade Representative can ask the International Trade Commission for an advisory report on whether U.S. law lets the Commission change its action so it agrees with the WTO findings. The Commission must send that report within 30 days after the request for an interim panel report, or within 21 days for an Appellate Body report. If most Commissioners say the action can be changed, the Trade Representative will talk with the relevant congressional committees. Then, if asked in writing, the Commission must issue a formal determination within 120 days that makes its action consistent with the WTO. The Trade Representative must consult Congress before the determination is put into effect. If that determination means an antidumping or countervailing duty order is no longer supported, the Trade Representative may direct the agency that enforces those orders to revoke the order, after consulting with Congress. If the WTO report criticizes the agency that enforces antidumping or countervailing duties, the Trade Representative will consult with that agency and Congress. That agency must, within 180 days after a written request, issue a determination to fix the problem. The Trade Representative will consult with the agency and Congress before implementation and may direct the agency to implement the determination. Any changes apply to unliquidated entries made on or after the date the Trade Representative directs revocation or implementation. Notices of implementation must be published in the Federal Register. Before making any determination, the Commission or the agency must let interested parties submit written comments and may hold a hearing.
