If a covered employee asks for a hearing within 10 days after a preliminary report is sent, the Executive Director must pick an independent hearing officer and start a private, on-the-record hearing in the Office. The request does not work if the preliminary report found the person is not covered or if the employee files a civil lawsuit instead. The hearing officer may throw out claims that are obviously frivolous or that fail to state a valid claim. The Executive Director picks hearing officers from rotating lists of qualified people. These lists include experienced lawyers or retired federal judges for personnel-type cases and technical experts on accessibility or safety. Members of Congress, congressional officers, the head of the employing office, Board members, and covered employees cannot be hearing officers. A person who did the preliminary review cannot be the hearing officer for the same claim. The hearing must start within 90 days of the request, though the time can be extended by agreement or for good cause by up to 30 days. The officer may allow limited prehearing discovery, and may issue subpoenas for witnesses or documents anywhere in the U.S. If someone refuses to obey a subpoena, the Board can ask the General Counsel to go to federal court to enforce it. The hearing officer must issue a written decision within 90 days after the hearing ends. The decision must describe the issues, the evidence, findings and legal conclusions, say whether a violation occurred, order appropriate remedies, and be entered in the Office records. If not appealed under the law’s appeal rules, the decision becomes the Office’s final decision. The hearing officer must follow applicable court and Board decisions.
