When a witness called to testify before either House of Congress, a joint committee, or any committee or subcommittee does not show up, does not bring required books or papers, or refuses to answer a relevant question, and Congress is told about that failure while it is in or out of session, a written report of the facts is filed with the President of the Senate or the Speaker of the House. The President of the Senate or the Speaker must certify that report with the Senate’s or House’s seal and send it to the appropriate United States attorney. The U.S. attorney must then take the matter to a grand jury.
