The Counsel must strongly defend certain constitutional powers and protections when they are challenged. That includes the privilege against arrest or questioning for speech or debate under section 6 of Article I; the Senate’s power under section 5 of Article I to judge elections, returns, qualifications, and to punish or expel members; the Senate’s power to keep parts of its journal secret and to set its rules; Congress’s “necessary and proper” lawmaking power; other constitutional powers or duties of the Senate or Congress; and the constitutionality of Acts and joint resolutions of Congress.
