A part B institution must meet the rules in section 1058(b)(1) subparagraphs (C), (D), and (E) and file an application with the Secretary to get its federal grant under section 1063. The application must say the funds will be used for the purposes in section 1062, promise to send an annual report, and require an audit at least once every 2 years by a qualified, independent group following Comptroller General standards and the Secretary’s rules. If the institution is already audited under chapter 75 of title 31, that audit can count for the same period. The Secretary must approve any application that meets these rules and cannot deny or change one without giving the institution notice and a chance for a hearing. Each application must also list measurable financial and academic goals and a plan to reach them.
