The Secretary must split the available funds among the States based on each State’s share of students who are eligible for the program, but no State can get less than it received in fiscal year 1979. The count of eligible students will come from the most recent year with reliable data. If the Secretary finds a State will not need all of its money for the program, the unused amount can be redistributed to other States based on their original shares, but only up to what each State can use. Any money moved this way counts as part of the receiving State’s allotment for that year. The Secretary will pay continuing incentive grants only to States that keep meeting the requirements in section 1070c–2(b).
