Require credit bureaus and the Secretary, guaranty agencies, lenders, and later holders of federal student loans to make formal agreements to share certain borrower information so loans get repaid responsibly. Under those agreements, for any student loan not paid back, the Secretary or lender must tell the credit reporting companies that the debt is an education loan (as defined elsewhere), the total borrowed and the current balance, the loan’s repayment status for the borrower’s credit file, the date it went into default and any collection activity (including if a payment was made to a prior holder), and the date the loan note was cancelled after full repayment or certain official payments. The agreements can let the Secretary or lender answer credit bureaus’ questions or respond when a borrower disputes information. The agreements can also let credit bureaus give borrower contact or location details to the Secretary or lender after a default notice to help with collection. They must require checking accuracy before any disclosure, quick updates when information changes or a borrower objects (as required by the Fair Credit Reporting Act), and that no unfair, harassing, or misleading collection methods be used. Default information cannot be sent to credit bureaus until the borrower has been warned and given at least 30 days to begin repayment; if the borrower still does not pay in a reasonable time (not less than 30 days), the information may be reported. Schools the borrower attended may receive this information to help locate or contact borrowers. Credit reports may show defaulted loan status for up to 7 years under specified starting points (payment of a claim, first reporting, or a new default after reentering repayment).
