The Secretary must, when practical, hire contractors to handle loan origination, servicing, and collection. The work must be offered at competitive prices. Only firms or agencies the Secretary finds qualified may get these contracts. For origination, servicing, and collection, contractors must have extensive, relevant experience and proven success. When possible, the Secretary should use State agencies that have agreements under sections 1078(b) and 1078(c) of the law, if they meet the qualifications. State agencies with a strong record of good performance should get special consideration. State agencies may also join together as a consortium. The Secretary may hire contractors for four main things: alternate loan origination for students whose schools do not have agreements under section 1087d(b), loan servicing and collection, creating and running one or more data systems to keep loan records, and any other program tasks the Secretary finds necessary for the program to work.
