The governor of every state must keep records about asbestos in school buildings. They must note where asbestos is, what testing, removal, or other responses were done (including what replacement materials were used), and any repairs made to return buildings to their previous condition. Each year the governor must send the EPA a ranked list of all schools served by local school districts that might need asbestos work. The list must rank schools by how bad current or possible asbestos exposure is. The governor must also send the EPA the schools’ applications for money and certify that each application honestly shows the school district’s financial situation. To check finances, the governor should, when possible, look at things like the state’s measure of need, local income, local tax rates compared to others, project cost as a share of the district budget, borrowing ability, extra costs for disadvantaged students, and any other signs of limited funds.
