Gives the Foundation the power to hire staff and run its operations. The Foundation can hire people without following the usual title 5 competitive-service rules. It can set pay up to the GS‑15 maximum under section 5332 of title 5, except up to 4 employees (in addition to the Executive Director under section 5603(f)(2)) may be paid at a Board-determined rate under section 5383 of title 5. The Foundation can hire temporary experts and consultants under section 3109 of title 5 but must not pay more than the rate for level IV of the Executive Schedule under section 5315 of title 5. It can make rules for how it operates, accept and use donations and gifts, use unpaid volunteers and repay their travel expenses (including per diem) as allowed by section 5703 of title 5, sign contracts and grants (and, with two-thirds of the Board agreeing, do so without performance bonds or following section 6101 of title 41), rent office space in Washington, D.C., and Tucson, Arizona, and make other needed expenditures. The same powers also apply to the National Center under section 5607a and to the Foundation’s activities under section 5604(7).
