Each State agency named in section 6431 (except Puerto Rico) can get a yearly grant. The state counts the eligible neglected or delinquent students who meet weekly hour rules: at least 15 hours in adult correctional education and at least 20 hours in either youth institution programs or community day programs. The grant equals that number times 40% of the State’s average per-student spending. That money amount cannot be less than 32% or more than 48% of the U.S. average per-student spending. The State must report the student count by a deadline the Secretary sets, and the Secretary can adjust the count for program length. Puerto Rico’s grant is its counted students times (its per-student spending as a share of the lowest State’s per-student spending) times 32% of the U.S. average. That share cannot be under 85%. If using that share would make any State or the District of Columbia get less than they got last year, Puerto Rico must use the larger of that share or the prior year’s share. If there is not enough money available, the Secretary must cut each grant proportionally.
