Summary

Says these rules do not stop a local school or school district from teaching English learners together with other students who have similar needs, in the same classes when that is appropriate. They also do not force a state or local school to start, keep, or end any specific kind of program for English learners. And they do not limit keeping or using Native American languages.

Nothing in this part shall be construed—

(1)to prohibit a local educational agency from serving English learners simultaneously with children with similar educational needs, in the same educational settings where appropriate;

(2)to require a State or a local educational agency to establish, continue, or eliminate any particular type of instructional program for English learners; or

(3)to limit the preservation or use of Native American languages.
