The Secretary of Education must write and update clear guidance about when student prayer is allowed in public elementary and secondary schools. The first guidance was due by September 1, 2002 and must be updated every two years. The guidance must be posted online where people can find it and checked first by the Justice Department’s Office of Legal Counsel to make sure it matches current law. Local school districts must give a written statement to their state by October 1 each year saying they do not have policies that stop students from taking part in constitutionally protected prayer as described in the guidance. States must tell the Secretary by November 1 each year which districts did not file or have complaints. The Secretary can make and enforce rules or orders against districts that fail to certify or that gave false certifications.
