The Secretary may hire outside experts or organizations (not Department employees) to review part or all of any application or request, such as petitions or notifications, for approval or classification under this chapter or under section 351(a) of the Public Health Service Act (42 U.S.C. 262(a)) for a biological product. Any contract must follow the confidentiality rules in section 379 of this title. The Secretary can use outside reviewers when doing so will make reviews faster or better, unless it would lower quality or unduly raise costs. Extra scientific or technical help can be used for new therapies and technologies. The FDA official responsible for the matter must review the outside expert’s recommendations and make the final decision in a timely way. The decision must meet the time limits set in this chapter or in the Public Health Service Act (42 U.S.C. 201 et seq.).
