Summary

The Commission may settle and pay up to $50,000 for property damage, personal injury, or death caused by operating the Panama Canal or its related facilities. Payments come from the Commission’s available funds. If someone accepts a payment, they give up any further claim against the United States and against any U.S. employee acting on the job. Except as allowed by section 3776, people may not sue the United States, the Commission, or its officers or employees for these claims. The rules in 28 U.S.C. 1346(b) and chapter 171 do not apply. Officers or employees can still be sued for acts outside their duties or for intentional harm.
