If you filed a damages claim under sections 3771(a) or 3772 and you disagree with the Commission’s decision, you may file a lawsuit against the Commission in the United States District Court for the Eastern District of Louisiana, as long as section 3779(b) allows. The case will be tried without a jury and must follow the rules in this part and the Panama Canal navigation regulations under section 3811. Any money ordered to pay a judgment can only come from funds set aside for Panama Canal maintenance and operation. You cannot sue the United States, the Commission, other courts, or any officers or employees in a different way. You must file the lawsuit within 180 days after the Commission mails its final decision or by May 17, 1998, whichever is later. The Commission’s appointed lawyers will defend it in the case.
