Summary

The Commission must create a Panama Canal Acquisition Regulation that tells how it will buy goods and services. The rules must follow the main parts of the Federal Acquisition Regulation, use efficient commercial practices, and be fit for Panama to adopt and keep using after the Canal Transfer Date. The Regulation must include rules to set up the Panama Canal Board of Contract Appeals (see section 3862). The Commission must also make a Supplement saying which federal procurement laws apply and which ones it waives. The Commission may waive many federal procurement laws, but it may not waive chapter 21 of title 41; chapter 71 of title 41 except section 7104(b) of title 41; or civil rights, environmental, or labor laws. The Commission must consult the Administrator for Federal Procurement Policy. The Regulation and Supplement take effect on the day they are published in the Federal Register or on January 1, 1999, whichever is earlier.
