§8809 Implementation; penalties

Summary

The President may use the authorities in 50 U.S.C. 1702 and 1704 to enforce and carry out this chapter. Anyone who breaks, tries to break, plans to break, or causes a break of this chapter or its rules must face the penalties in 50 U.S.C. 1705(b) and (c), to the same extent as violations covered by 1705(a). Parts of the Iran Sanctions Act of 1996 also apply when imposing sanctions under sections 8803(d), 8804(a), and 8805(a). Those parts are certain paragraphs of section 4(c); subsections (c), (d), and (f) of section 5; and sections 8, 11, 12, and 13(b). They apply like they do under section 5(a) of that Act and can replace sections 8803(i), 8804(g), and 8805(e) when appropriate.

Title 22, §8809

(a)The President may exercise all authorities provided under section 1702 and 1704 of title 50 to carry out this chapter.
(b)The penalties provided for in subsections (b) and (c) of section 1705 of title 50 shall apply to a person that violates, attempts to violate, conspires to violate, or causes a violation of this chapter or regulations prescribed under this chapter to the same extent that such penalties apply to a person that commits an unlawful act described in section 1705(a) of title 50.
(c)The following provisions of the Iran Sanctions Act of 1996 (Public Law 104–172; 50 U.S.C. 1701 note) shall apply with respect to the imposition of sanctions under section 8803(d), 8804(a), and 8805(a) of this title to the same extent that such provisions apply with respect to the imposition of sanctions under section 5(a) of the Iran Sanctions Act of 1996, and, as appropriate, instead of section 8803(i), 8804(g), and 8805(e) of this title:
(1)Paragraphs (1)(A), (2)(A), and (2)(B)(i) of section 4(c).
(2)Subsections (c), (d), and (f) of section 5.
(6)section 13(b).
