Projects paid in whole or part by grants under sections 402 or 405 must follow the rules the Secretary creates. A funded project is any project paid by a grant under 402 or 405. If a grant requires a State to pay part of the cost, the State can count its other state-funded highway safety spending in that fiscal year (not federal money and not planning or admin costs) toward the non‑federal share for other funded projects that year, even if the money was spent on a different project. To get a grant, a State must send an application with the information, form, and timing the Secretary requires, and the Secretary will set one deadline so grants can be awarded early in the fiscal year. Within 60 days after the later of the start of the fiscal year or the date an appropriations law makes funds available, the Secretary must give each State the portion of those funds it is entitled to for that year.
