Only Alaska tribes that had at least 25 members who are Natives (as defined in title 43, section 1602(b)) living in the tribe’s village on June 1 of the prior fiscal year can receive tribal priority allocation funds on or after October 11, 2000. If a tribe does not meet that rule, the money must go to the Alaska Native regional nonprofit corporation listed in section 103(a)(2) of Public Law 104–193, even if a tribal resolution says otherwise.
