The Secretary, through the Service, may give contracting preference to any Indian or any business owned and controlled by Indians — including former or currently federally recognized tribes in New York — for building or fixing Service facilities under section 1631, and for building safe water and sanitary waste disposal systems under section 1632. The Secretary must not give the preference if, under rules he makes, the project would not be done properly or could not be finished or maintained. In deciding, he must look at six things such as Indian ownership and control, equipment, bookkeeping, knowledge of the work, trained staff, and other needed abilities. The Secretary must also make sure workers on these projects are paid at least the prevailing local wages for similar work, as set in sections 3141–3144, 3146, and 3147 of title 40.
