Gives grants to tribes and tribal organizations that run Bureau-funded contract or grant schools so they can pay necessary administrative and indirect costs without cutting direct services. Every stand-alone school must get at least $200,000 per year. The grants are extra money and do not reduce the regular program funds. The Secretary must lower a grant if the tribe already got administrative money from another federal education program and must try to recover from other agencies when those agencies fund the program. The grant size is found by applying an administrative cost percentage to the tribe’s total Bureau-funded school program money. Key terms: administrative costs (needed admin work like contract and grant admin, leadership, planning, fiscal and personnel management, office services, insurance, audits, legal and safety); Bureau elementary and secondary functions (all programs and facility funds run through Bureau schools); direct cost base (the tribe’s aggregate direct program funding two years before, or one year before if not available, or projected for a first year); maximum base rate = 50%; minimum base rate = 11%; standard direct cost base = $600,000. The percentage is calculated as (direct cost base × minimum rate + standard base × maximum rate) ÷ (direct cost base + standard base) and is rounded to two decimal places. Tribes may combine these grants into one administrative account, include shared indirect funds, and keep the money with no fiscal year limit. The Director had to study cost factors and report to Congress within 120 days after January 8, 2002. Congress may appropriate needed funds, but if total appropriations fall short, the Secretary must cut each grant proportionally. The rule also applies to schools under the Tribally Controlled Schools Act, and budget requests starting in 2002 must include full funding information; funds for new schools must be at least 10% of the amount needed for current schools.
