Defines the main words used in this chapter. The Bureau means the Bureau of Indian Affairs in the Department of the Interior. Eligible Indian student has the meaning given in section 2007(f) of this title. Indian means a member of an Indian tribe, someone eligible for tribe membership, or that person’s child or grandchild. Indian tribe means any tribe, band, nation, or similar organized group — including Alaska Native Village or Regional Corporations created under the Alaska Native Claims Settlement Act — that the United States recognizes for special Indian programs and services. Local educational agency means a public board or other public authority that runs or oversees K–12 public schools in a state, or any public institution that has administrative control of a public elementary or secondary school. Secretary means the Secretary of the Interior. Tribal governing body means the tribe’s recognized governing body for a school that gets help under this Act. Tribal organization means either the tribe’s governing body or a legal Indian organization controlled, approved, or democratically elected by the adult members and that includes strong Indian participation; if a tribally controlled school serves more than one tribe, approval by governing bodies representing 80% of the students is enough for a grant. Tribally controlled school means a school run by a tribe or tribal organization that serves preschool through grade 12, is not a local educational agency, and is not directly run by the Bureau.
