Title 25 › Chapter CHAPTER 8— - RIGHTS-OF-WAY THROUGH INDIAN LANDS › § 312
Allows railroad companies to get rights of way for railroads, telegraph, and telephone lines through Indian reservations (except Oklahoma), lands kept for Indian agencies or Indian service, and individual Indian allotments that are not fully transferred with the right to sell. Companies must follow sections 312 to 318 and the rules under them. The Secretary of the Interior must be sure the company applied in good faith and can build, and must hear anyone who objects. If a railroad already exists or is being built, no parallel right of way will be given within ten miles on either side unless the Secretary finds it serves the public. As a condition, the company must build and keep suitable passenger and freight stations for every government town site along the line.
