The Secretary must set up a program to help tribes and tribal energy groups develop energy on Indian land and move toward self‑rule. The program must give development grants, grants for projects, low‑interest loans, and technical help. It must fund a tribal environmental group to create a national center for training, model environmental rules, and review standards. The Secretary must consult tribes before approving well‑spacing plans. The Secretary must work with the Department of Energy’s Office of Indian Energy and help tribes make energy plans for electrification, permitting, renewables, efficiency, generation, transmission, water, and resource protection. Money was authorized as needed for each fiscal year 2006 through 2016. The Director must run competitive grant programs and other help for tribal energy education, planning, construction, electrification, utilities, and transmission. The Director will use DOE national labs and start tribal carbon sequestration research (including geologic, forest, and agricultural methods) that is coordinated with other DOE work and uses standard measurement approaches. Grants can use a formula, give priority to tribes with inadequate electric service, and encourage cooperation with utilities. The Secretary of Energy may cut required cost shares to as low as 10 percent for eligible tribes. Section 16352 of Title 42 does not apply to this help. The law authorizes $30,000,000 for each of fiscal years 2021 through 2025. The Secretary of Energy may also guarantee loans for tribal energy projects, with an outstanding guarantee cap of $20,000,000,000, must issue needed regulations within 1 year after December 18, 2018, and had to report to Congress within 1 year after August 8, 2005 about tribes’ financing needs. Federal agencies may prefer buying energy from businesses majority‑owned by tribes, but they must pay no more than market price and must get usual market terms.
