Contractors and subcontractors (not tribes or tribal organizations) who hire workers to build, change, paint, or repair buildings or facilities under these federal contracts or grants must pay those workers at least the local prevailing wage. The Secretary of Labor sets those wage rates under sections 3141–3144, 3146, and 3147 of title 40. For work covered by the Act of March 3, 1921, the Secretary has the duties given in Reorganization Plan No. 14 of 1950 and section 3145 of title 40. Contracts, subcontracts, grants, and subgrants under this chapter and related Acts must, as much as possible, give Indians first chance at training and jobs and give preference in awarding subcontracts and subgrants to Indian organizations and Indian-owned economic enterprises (see section 1452). If a self-determination contract is meant to benefit a single tribe, that tribe’s own employment and contract preference laws control.
