Allows a person to start, defend, or appeal a federal case without paying court fees up front if they sign a sworn statement saying they cannot pay and listing all their assets, the kind of case, and why they think they should win. A prisoner must also give a certified copy of their prison trust account statement for the 6 months before filing. A court can refuse free appeals if a judge says the appeal is not made in good faith. If a prisoner gets permission to proceed without paying up front, they still must pay the full filing fee over time. First they must pay an initial partial fee equal to 20% of the larger of (a) their average monthly deposits or (b) their average monthly balance over the prior 6 months. After that, they must pay 20% of each month’s income credited to their account. The prison will send money to the court whenever the inmate’s account has more than $10, until the fees are paid. The total collected can never exceed the allowed filing fee. The court can order the United States to pay required printing or transcript costs when authorized by the Director of the Administrative Office of the United States Courts. The court may ask a lawyer to represent someone who cannot afford one, and it must dismiss the case if the poverty claim is false or if the case is frivolous, malicious, fails to state a claim, or seeks money from someone who is immune. If a prisoner has had 3 or more prior cases dismissed as frivolous, malicious, or for failing to state a claim while confined, they cannot file without paying unless they are in imminent danger of serious physical injury. “Prisoner”: a person held in a jail, prison, or similar facility, including those accused, convicted, or under probation, parole, pretrial release, or diversion.
