When a U.S. marshal dies, is removed, or their term ends after they have seized real estate under a court order but before it is sold or finally handled, the new marshal must get the same orders and continue the case as if nothing changed. If the marshal sold the property but left office before signing the deed, the buyer or the plaintiff can ask the court, explain the facts and why the title wasn’t finished, and the court may order the new marshal to complete the title and sign the deed once the buyer pays the purchase money and unpaid costs.
