If your property was seized under a warrant, you must notify the U.S. Attorney and, at least twenty days before the warrant’s return day, you can file a plea denying the affidavit’s claims or saying the defendant does not own the property. Either side can ask for a jury; if both agree to waive a jury, the judge decides. If you want the property back you must use this process, but you still may later sue for trespass or other damages.
