It is illegal to fire, fine, suspend, expel, discipline, or otherwise treat unfairly someone who takes part in or receives benefits from an employee benefit plan because they use or try to get rights under the plan, this subchapter, section 1201, or the Welfare and Pension Plans Disclosure Act. It is also illegal to punish anyone for giving information or testifying in investigations or proceedings about these laws. For multiemployer plans, plan sponsors and others may not discriminate against a contributing employer for using rights under this chapter or for giving information or testifying before Congress. Enforcement follows the rules in section 1132.
