A person hurt by a Commission order can ask a federal court of appeals to change or cancel that order. They must file a written petition in the appeals court for the circuit where the violation happened, where the employer’s main office is, or in the D.C. Circuit, within 60 days of the order. The court gets the case record from the Commission, can give temporary relief if needed, and can confirm, change, or throw out the Commission’s order and enforce whatever it affirms. Filing for review does not stop the Commission’s order unless the court says so. The court normally won’t hear objections that were not raised before the Commission unless there are extraordinary reasons. The Commission’s factual findings are final if they are supported by substantial evidence. The court may allow new evidence to be added and send it back to the Commission, which can revise its findings. Once the record is filed, the appeals court has sole control and its decision is final except for possible Supreme Court review. The Secretary may also ask a court to review or enforce a final Commission order using the same rules. If no one seeks review within 60 days, the Commission’s findings and order become final for later enforcement and the court clerk will enter a decree enforcing it. Courts enforcing such decrees can impose the law’s penalties and other remedies. Employers are not allowed to fire or punish an employee for filing a complaint, starting or helping a proceeding, or testifying. An employee who thinks this happened must file a complaint with the Secretary within 30 days. The Secretary will investigate and, if he finds a violation, must sue in federal district court. The district court can stop the discrimination and order relief such as rehiring and back pay. The Secretary must tell the employee his decision within 90 days of getting the complaint.
