Sets each State’s allotment percent using per-person income. Do this: divide the State’s per-capita income by the U.S. per-capita income, multiply that by 50%, and subtract the result from 100%. The final percent cannot be more than 75% or less than 33 1/3%. The District of Columbia, Puerto Rico, Guam, the Virgin Islands, American Samoa, and the Commonwealth of the Northern Mariana Islands get 75%. The Secretary of Education must publish these percentages between October 1 and December 31 of every even-numbered year. The numbers use the average per-capita incomes for the three most recent consecutive years from the Department of Commerce and apply to the next two fiscal years starting the following October 1. For this rule, "United States" means the 50 States and the District of Columbia. The Department of Commerce must provide the latest population data by October 1 before the fiscal year.
