Local governments must not get more money for a payment period than their adjusted tax amount as set under section 6705(b)(3). Any money above that adjusted tax amount goes to the governor of the state where the local government is located. If a local government (not an Indian tribe or an Alaskan native village) would get less than $5,000, or it waives the payment, the Secretary will send that money to the state governor. The governor must spend those funds on the programs listed in section 6701(a)(2) in the areas where the local governments are. If an Indian tribe or Alaskan native village would get less than $5,000 or waives the payment, the money will not go to the tribe. Instead, those small amounts are pooled and the Attorney General will give competitive grants to tribes and villages for the programs in section 6701(a)(2) or for building or fixing prisons and other correctional facilities.
