The Secretary of the Army can give money to a State to help its Army National Guard do duties the Secretary assigns, if the Chief of the National Guard Bureau agrees. The Secretary decides how much to give. Money may only pay for activities that fall under three specific Army responsibilities (title 10, section 7013(b), paragraphs 6, 10, or 11), and the Guard must have been chosen through open competition that lets qualified public and private bidders apply, subject to section 3204(a) of title 10. The competition rule does not apply to work that federal or State employees were doing on October 17, 1998. Payments must be made through the Chief of the National Guard Bureau, and Army funds appropriated for a fiscal year can be used to support these activities during that fiscal year.
