The Secretary of the Army must label certain parcels in West Deptford Township, Gloucester County, New Jersey, as nonnavigable unless, after talking with local and regional public officials (including planning groups), he decides that one or more proposed projects in those parcels would not be in the public interest. The parcels are shown on Tax Assessment Map #26, Block #328, Lots #1, 1.03, 1.08, and 1.09. That nonnavigable label only applies to parts of those parcels that are or will be bulkheaded and filled or otherwise occupied by permanent structures, including marina facilities. Any such work must follow other federal laws, including the Act of March 3, 1899 (30 Stat. 1121, chapter 425), section 1344 of this title, and the National Environmental Policy Act of 1969 (42 U.S.C. 4321 et seq.). If by 20 years after November 12, 2001 (that is, by November 12, 2021) any area or part of an area has not been bulkheaded, filled, or otherwise occupied as required, or if work authorized is not started within 5 years after permits are issued, the nonnavigable designation ends for that area.
