Title 33 › Chapter CHAPTER 15— - FLOOD CONTROL › § 702d
The United States must provide flowage rights for extra floodwaters caused by diverting the Mississippi River. If the flood-control work makes nearby property more valuable or gives it other benefits, those benefits must be used to lower the payment made to the owner. The Secretary of the Army may start legal proceedings to acquire land, easements, or rights-of-way needed for the project in the U.S. district court where the property is located, following state court practice as closely as possible. The Secretary can buy land at a price an owner sets if that price is reasonable and can accept donations. Sections 594 and 595 of this title apply. Any land acquired under these rules must be given free to state or local governments.
