A deputy commissioner may review a compensation case on their own or if someone involved asks (this includes an employer or carrier given relief under section 908(f)). The review can happen if the worker’s condition changes or if a factual mistake is found. It can be done any time before one year after the date of the last payment of compensation, whether or not a prior compensation order exists, or any time before one year after the rejection of a claim. Reviews follow the claim rules in section 919 and include cases paid under section 944(i). After review the deputy commissioner can issue a new order to stop, continue, restart, raise, lower, or award compensation. The order does not change money already paid, except an increase can be made effective from the date of the injury. A decrease can be made effective from the date of the injury only if some compensation due is still unpaid, and any earlier overpayment may be deducted from unpaid amounts in the manner the deputy commissioner decides with the Secretary’s approval. Settlements cannot be changed.
