Under this program, money can pay to plan, develop, or run the program. It can also pay up to 50 percent of the cost to build a new, small community-based facility for fewer than 20 persons if the Administrator finds it necessary. Other than that limited building case, the funds cannot be used for construction. No funds can go to a residential program (not including a private home) unless three things are true: the State requires providers be licensed only after meeting clear rules that forbid neglect and physical and mental abuse; the provider is licensed under that State law; and if the provider is in a different State than the placing order, the placing official certifies the provider meets the originating State’s rules for discipline, education, and health care and follows the Interstate Compact on the Placement of Children.
